General Terms & Conditions

These Booking Terms and Conditions are for the bookings of SAii and Santiburi brands of S Hotels & Resorts Public Company Limited made directly via our websites.

We reserve the right to revise all or part of these Booking Terms and Conditions from time to time by updating this page. The revised terms and conditions will take effect immediately when they are published on this page. The guest will be bound by the version of Booking Terms and Conditions in force at the time that the guest make a booking.

By using this website, the guest agrees to be bound by these Booking Terms and Conditions.

1. Fees and Payment

1.1 A Third-Party Payment Gateway
For the payment process, the guest understands that the guest will be directed to a payment gateway which is operated by a third-party. We take no responsibility for the services and the contents provided by a third-party.

1.2 Taxes
The fees shown in a payment gateway are inclusive of applicable taxes. We reserve the right to additional charge any taxes and levies imposed by a governmental agency or local authority, arising after the date of a booking to the guest.

1.3 Credit Card
A valid credit card is required at booking time. The credit card used at the time of booking must be presented by the guest with positive identification upon check-in at the hotel. The guest is responsible for the credit card charges as well as foreign exchange for conversion to different currency (if any).

1.4 Deposit
A deposit may be required at the hotel upon check-in.

1.5 Additional Services Fees
Additional services fees will be charged at the hotel based on the guest requirement during the guest’s stay period (if any).

1.6 Pricing Errors
We reserve the right to cancel any bookings based upon incorrect information being displayed in relation to fees or services at any point in time.

2. Cancellation Policy
The guest may cancel the booking in accordance with a cancellation policy which is set out in the Booking Confirmation Letter.

3. Check-In and Check-Out

3.2 Early Check-In and Late Check-out
On request. Please contact the front office of the hotel. Additional fees may apply.

3.3 Early Check-Out
Depending on the type of your reservation, we may not be able to provide refund for payment in case of the early check-out, or we may have to charge an early departure fee in the event the guest departs earlier than the original departure date which shown in a booking. Please contact the front office of the hotel for more information.

3.4 No Show
In the event the guest fails to show up on the first day of hotel booking, the booking will be cancelled in full, and the total amount paid upon the time of booking will not be refunded.

4. Relocation
In the rare unexpected event whereby the hotel cannot provide accommodation as previously confirmed, the hotel will comply with its standard of obligation by undertaking to relocate the guest into an alternative hotel of equal or better grading at no expense to the guest. Should there not be a hotel of equal or better grading in the vicinity of the original booking, it may be required to provide the guest with a hotel of a lesser grading. If this is the case, any reduction in costs will be refunded to the guest.

The alternatives offered are at the hotel’s discretion. Should the guest wishes to choose a hotel of a standard other than offered under this condition, then the guest will be required to pay any difference.

5. Insurance
We strongly recommend the guest purchases comprehensive travel insurance. We suggest that the policy include, but not be limited to, the following coverage – loss of payment through cancellation, loss or damage to personal baggage, loss of money and medical expenses.

6. Force Majeure
Impossibility: a booking will be cancelled without liability to either party in the event of force majeure. Such causes include but are not limited to, acts of God; regulations or orders of governmental authorities; pandemics and/or disease such as but not limited to COVID-19, SARS, Legionnaires; fire, flood, explosion, global war, disaster; civil disorder or riot; curtailment of transportation facilities or other transportation warnings making it inadvisable, illegal or otherwise impossible to provide the accommodations or the services; strike, lockout, work stoppage, other restraints of labor, either partial or general from whatever cause.

7. Disclaimers
As a condition of the guest’s use of this website, the guest warrants to us that the guest will not use this website for any purpose that is unlawful or prohibited by these terms, conditions and notices. Although we may from time to time monitor or review discussions, chats, postings, transmissions, bulletin boards and the like on this website, We are under no obligation to do so and assumes no responsibility or liability arising from the content of any such locations nor for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in any information within such locations on the website. The guest is prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. We will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity of anyone posting any such information or materials.

8. Limitation of Liability
We and hotel shall not be responsible for indirect damage, damage arising from consequential damage or special circumstances, including but not limited to loss of revenue, loss of profit, loss of use, loss of opportunity, arisen out of the performance or non-performance of obligations under these Booking Terms and Conditions.

Also, we and hotel shall not be responsible for any damages arising, during the guest’s stay, from any events beyond the reasonable control of us and hotel, including but not limited to force majeure events as mentioned above.

9. Privacy and Personal Data Protection
For the purpose of booking, we shall collect and process the guest’s personal data. The details of all information required for this purpose and other terms and conditions related to the privacy and personal data protection are set out in the Privacy Notice. The guest shall ensure that the guest read the Privacy Notice carefully.

10. Links to Third Parties
We do not control any third-party website and is therefore not responsible for the content of any linked website or any link contained in a linked website. We provide such links only as a convenience to the guest and the inclusion of any link does not imply endorsement, investigation or verification by us of the linked website or any information contained in it.

11. Governing Law
These Booking Terms and Conditions are governed by Thai law, without the mandatory protective provisions that may be applicable in the country of residence of the guest.
